Late Charge $7.50 or 5% of unpaid scheduled payment, whichever is greater, if not paid in full within 10 days of the due date
Cost of Collection Upon default and referral to an attorney, the borrower may be charged attorney’s fees and collection costs as permitted by law
Consumer Reimbursement Obligation The consumer is responsible for reimbursing the CSO for any payments made on their behalf to the lender, including any interest or fees incurred

Note: The CSO fee is not interest but a charge for the credit service itself. The consumer enters a separate agreement with the CSO for these services.


Default and Collection

  • If the borrower defaults, and the matter is referred to an attorney, the borrower may be liable for:
    • Attorney’s fees
    • Court costs
    • Other lawful collection costs

Important Consumer Disclosures

  • Right to Prepay: Borrower may pay the loan in full at any time without penalty.
  • Repayment Schedule: Clearly outlined at the time of loan agreement.
  • State Law Compliance: All fees and practices must comply with the Texas Finance Code and the Office of Consumer Credit Commissioner (OCCC) regulations.
